Kit Kat loses 16-year-old case to trademark 4-fingered shape

New Delhi: The EU court on Wednesday dismissed a 16-year-old appeal by Kit Kat maker Nestlé, which argued it owns the chocolate’s 4-fingered wafer bar shape.
“Nestlé did not show its shape was a sufficient mark of distinctive character in the countries it seeks trademark,” the court said. The EU granted Nestlé trademark in 2006, which was contested by Cadbury’s parent Mondelez.
