Petition in HC challenging Maharastra govt’s Maratha quota move

MUMBAI: A petition was filed in the Bombay High Court on Monday seeking to strike down the reservation to Marathas as it is unconstitutional. According to the petitioner, advocate Gunaratna Sadavarte, the 16 per cent quotas for the Marathas recently announced by the state government was violative of the Constitution.

On Nov 29, the Maharashtra legislature passed a bill granting 16% reservation in education & govt. jobs for the Maratha community under the socially and educationally backward category (SEBC).

Sadavarte is likely to mention the petition before a division bench of Chief Justice N H Patil and Justice M S Karnik on December 6. Last week, Vinod Patil, a petitioner from the Maratha community, had filed a caveat in the Bombay High Court seeking to be heard before any order was passed staying the quota. The bill was approved & signed by the Maharashtra governor on Nov 30.
